These Terms of Service govern your access to and use of the website available at humanitybadge.com, including user accounts, profiles, badges, micro-credentials, community functions and other services made available through the website. Please read these Terms carefully. By creating an account, accessing or using Humanity Badge, you confirm that you have read, understood and agreed to these Terms. 1. You can contact the platform administrator at: hello@humanitybadge.com You may write to us at any time regarding your account, the Platform, technical problems, payments, micro-credentials, another user’s conduct or content that may violate these Terms. 2. About Humanity Badge Humanity Badge is an online platform intended to support individuals, organisations, professionals, volunteers, mentors and other people interested in social impact, humanitarian action, international development, education and related fields. Depending on the functions currently available, users may be able to: create and maintain a user profile, present their experience, skills and achievements, obtain and display badges or micro-credentials, discover organisations, programmes, grants, opportunities or educational resources, communicate or cooperate with other users, submit forms, applications or requests, participate in learning, mentoring or community activities, use other tools made available through the Platform. The availability of particular functions may change as the Platform develops. 3. Free use of the Platform Humanity Badge is a free platform. Creating an account and using the standard functions of the Platform does not require a subscription fee. The only paid services currently offered through the Platform are selected micro-credentials. A micro-credential is paid only when it is clearly marked as a paid service before the user orders it. We will not charge you merely for creating an account, maintaining a profile or accessing functions that are presented as free. Before ordering a paid micro-credential, you will be shown: the price, the main features of the micro-credential, any assessment or eligibility requirements, the expected validity period, where applicable, any other important conditions of the purchase. You will not be charged without actively confirming the purchase. 4. Eligibility You may use the Platform only if you are legally permitted to enter into an agreement under the laws applicable to you. Users under the age of 18 may use the Platform only where permitted by applicable law and, where required, with the consent of a parent or legal guardian. When creating an account on behalf of an organisation, you confirm that you are authorised to act on behalf of that organisation. We may request reasonable information necessary to verify your identity, age, authority to represent an organisation or eligibility for a particular service or micro-credential. 5. User accounts To use certain functions, you may need to create an account. You agree to: provide accurate and current information, keep your account information up to date, protect your password and login details, avoid sharing access to your account with unauthorised persons, notify us promptly if you believe that your account has been compromised, accept responsibility for activity performed through your account, unless the activity resulted from circumstances beyond your reasonable control. You may not create an account using another person’s identity or falsely claim to represent another person or organisation. One person should normally maintain one personal account unless we expressly allow otherwise. We may refuse or remove usernames, organisation names or profile information that are misleading, unlawful, offensive or infringe third-party rights. 6. Respect for other users Humanity Badge is intended to be a respectful, inclusive and constructive community. You must treat other users with dignity and respect, including people whose nationality, culture, language, background, experience, profession or opinions differ from your own. When using the Platform, you must not: harass, bully, threaten, intimidate or deliberately humiliate another person, publish hateful or discriminatory content, attack another person based on protected or personal characteristics, encourage violence, self-harm or harm to others, publish another person’s private information without permission, repeatedly contact another user after being asked to stop, impersonate another person or organisation, make deliberately false accusations, use abusive, degrading or sexually explicit language towards another user, exploit, manipulate or place undue pressure on vulnerable persons, engage in fraud, deception or dishonest conduct. Disagreement and constructive criticism are permitted. Personal attacks, threats and harassment are not. Users should communicate professionally, especially when discussing humanitarian work, vulnerable communities, employment, volunteering, education, grants or professional qualifications. 7. Prohibited activities You may not use Humanity Badge to: break any applicable law or regulation, upload or distribute illegal content, commit fraud or obtain money, services or personal information through deception, publish false qualifications, achievements, references or credentials, falsely claim that you have earned a badge or micro-credential, manipulate the assessment or verification process, sell, transfer or share a personal micro-credential with another person, distribute malware, harmful code or malicious links, interfere with the security or proper operation of the Platform, attempt to gain unauthorised access to accounts, systems or data, collect or scrape data from the Platform without our prior written permission, send spam, unsolicited commercial messages or repetitive promotional content, create fake accounts or use automated accounts without permission, misuse grants, job offers, mentoring opportunities or contact information published on the Platform, infringe copyright, trademarks, privacy rights or other third-party rights, use the Platform to support terrorism, human trafficking, exploitation, violence or other serious harm. You must not attempt to avoid restrictions imposed on your account by creating another account or using another person’s account. 8. User content “User Content” means information, text, images, documents, profile descriptions, comments, links, applications, messages and other materials submitted to the Platform by a user. You retain ownership of your User Content. By submitting User Content, you give Humanity Badge a non-exclusive, worldwide and royalty-free licence to host, store, reproduce, display, format and technically process that content only to the extent reasonably necessary to: operate the Platform, display the content according to your selected settings, provide the service requested by you, protect the Platform and its users, moderate or investigate potential violations, maintain backups and platform security. This licence ends when the content is deleted, except where temporary backup copies remain or retention is required by law, for security purposes or for the establishment, exercise or defence of legal claims. You confirm that: you own the User Content or have permission to use it, the content is accurate to the best of your knowledge, publishing the content does not violate another person’s rights, the content complies with these Terms. You remain responsible for your User Content. 9. Public profiles and visibility Some information submitted to Humanity Badge may be visible to other users or publicly available on the internet. Before publishing personal or confidential information, check the available visibility or privacy settings. Do not publish sensitive personal information that is not necessary for your use of the Platform. This includes identification document numbers, passwords, payment card details, medical records or private information concerning another person. Information that you intentionally publish on a public profile may be viewed, copied or shared by other internet users. Humanity Badge cannot fully control how third parties use information that you have deliberately made public. 10. Micro-credentials and badges Humanity Badge may offer badges and micro-credentials confirming participation, completion of an activity, verification of information, assessment of skills or achievement of defined criteria. The detailed requirements for a micro-credential may be presented on its description or order page. A micro-credential may require: completing a course, activity or assessment, submitting evidence, participating in an interview, having information verified, meeting defined experience or competency criteria, paying the displayed fee where the micro-credential is marked as paid. Humanity Badge may refuse to issue, suspend or revoke a micro-credential where: the required criteria have not been met, information or evidence supplied by the user is false or misleading, the assessment process has been manipulated, the credential has been transferred or misused, the credential was issued as a result of an administrative or technical error, continued display of the credential would be unlawful or materially misleading. Where reasonably possible, we will explain the reason for refusing, suspending or revoking a micro-credential and allow the affected user to request a review. Unless expressly stated otherwise, Humanity Badge micro-credentials: are not university degrees, are not state-issued professional licences, do not replace qualifications required by law, do not guarantee employment, promotion, funding or admission to a programme, do not guarantee that every employer or institution will recognise them. A credential may include an expiry date or require renewal. Any such condition will be indicated in its description. 11. Payments for selected micro-credentials The price of each paid micro-credential will be displayed before purchase. Payments may be processed by an external payment service provider. The payment provider may apply its own terms and privacy rules. Where required by law, the displayed price will include applicable taxes or the applicable taxes will be clearly shown before the order is confirmed. The micro-credential assessment or verification process may begin after payment has been successfully completed. If payment is cancelled, reversed, disputed or obtained fraudulently, we may suspend the related assessment or credential while the matter is investigated. 12. Consumer rights and withdrawals Nothing in these Terms limits any mandatory consumer rights available under applicable law. Where you purchase a paid service as a consumer, you may have a statutory right to withdraw from the contract within 14 days without giving a reason. Where you ask us to begin providing the paid service before the end of the withdrawal period, we may ask you to: expressly request that performance begin immediately, acknowledge that you may be required to pay for the part of the service already performed, acknowledge, where permitted by law, that you may lose the right of withdrawal after the service has been fully performed. The specific withdrawal information applicable to a purchase should be displayed during the order process or provided in the purchase confirmation. The right of withdrawal does not affect your rights where a paid digital service is defective, does not match its description or has not been supplied as agreed. Information about grants and opportunities Humanity Badge may display information about grants, funding programmes, jobs, volunteering, events, educational programmes or other third-party opportunities. This information is provided for general informational purposes. Unless expressly stated otherwise, Humanity Badge: is not the organiser or funder of the opportunity, does not control the third party’s selection process, does not guarantee that information supplied by a third party is complete or current, does not guarantee that a user will receive funding, employment, admission or any other benefit. You should verify deadlines, eligibility requirements and official documents directly with the relevant organiser before making decisions or incurring costs. Information on the Platform does not constitute legal, financial, tax, investment or professional advice. 14. Moderation and enforcement We may review User Content or account activity where: another user submits a report, we receive a legal notice or authority request, automated security or anti-spam tools identify potential abuse, we become aware of a possible violation through another reasonable method. Moderation may involve automated tools and human review. Automated tools may be used to identify spam, malware, suspicious login activity, fraudulent behaviour or other security risks. Depending on the seriousness and frequency of the violation, we may: issue a warning, request that content be corrected, limit the visibility of content, remove content, restrict particular Platform functions, temporarily suspend an account, permanently terminate an account, suspend or revoke a badge or micro-credential, report suspected illegal activity to the competent authorities where required or justified. We will seek to apply moderation decisions proportionately and consistently. Where reasonably possible and legally permitted, we will inform the affected user about the action taken and the main reason for the decision. Immediate action may be taken without prior warning where necessary to protect users, prevent fraud, address serious security risks, comply with law or respond to manifestly illegal or seriously harmful content. 15. Reporting content or behaviour You may report content, an account or another user’s behaviour by contacting: hello@humanitybadge.com A report should include, where possible: a link or clear description identifying the content or account, an explanation of why you believe it violates these Terms or applicable law, any relevant evidence, your contact details, a statement that the information in your report is accurate to the best of your knowledge. We may contact you for further information. Submitting a report does not guarantee that content will be removed. We will assess reports based on the available information, these Terms and applicable law. Knowingly submitting false or abusive reports may itself be treated as a violation of these Terms. 16. Requesting a review of a moderation decision Where we remove your content, restrict your account, refuse or revoke a micro-credential, or take another material enforcement action, you may request a review by writing to: hello@humanitybadge.com Unless a different period is required by law, the review request should normally be submitted within six months of the decision. Your request should explain: which decision you want us to review, why you believe the decision was incorrect, any relevant facts or supporting evidence. Where automated tools contributed to the original decision, we may arrange human review of the decision. We will consider the request in a timely, fair and non-discriminatory manner and communicate the result to you. 17. Intellectual property The Platform, its software, design, layout, databases, logos, graphics and original materials are owned by or licensed to Humanity Badge and are protected by intellectual property laws. Subject to these Terms, Humanity Badge gives you a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purposes. You may not, without prior written permission: copy or redistribute substantial parts of the Platform, use Humanity Badge branding in a misleading way, reverse engineer or interfere with Platform software, create a competing database by systematically extracting Platform content, sell or sublicense access to the Platform, suggest that Humanity Badge endorses you, your organisation or your services where no such endorsement has been given. You may display a valid Humanity Badge credential issued to you in accordance with any applicable credential or branding guidelines. 18. Third-party services and links The Platform may contain links to third-party websites, services, payment providers, organisations or resources. Humanity Badge does not control third-party services and is not responsible for their availability, security, content or privacy practices. A link does not automatically mean that Humanity Badge endorses the third party. You use third-party services subject to their own terms and at your own discretion. 19. Privacy and personal data We process personal data in accordance with applicable data protection law and the Humanity Badge Privacy Policy. The Privacy Policy explains, among other matters: what personal data we collect, why we process it, the legal basis for processing, how long information is retained, when information may be shared, your data protection rights, how to contact us about personal data. The Privacy Policy is available at: https://humanitybadge.com/privacy-policy If this address changes, the current Privacy Policy will remain accessible through the Platform. 20. Platform availability We aim to keep Humanity Badge available and secure, but we do not guarantee uninterrupted or error-free operation. Access may be temporarily limited because of: maintenance, technical problems, security incidents, updates, events beyond our reasonable control, legal or regulatory requirements. We may update, improve, replace or discontinue particular functions. Where a change materially affects users, we will seek to provide reasonable notice, unless urgent action is required for legal, security or technical reasons. 21. Disclaimer The Platform is provided on an “as available” basis. To the extent permitted by law, Humanity Badge does not guarantee that: every piece of user-supplied information is accurate, every user is who they claim to be, use of the Platform will produce a particular professional or financial result, a grant, job or programme displayed on the Platform will remain available, a third party will recognise a badge or micro-credential, the Platform will always operate without interruption. You are responsible for evaluating information obtained through the Platform before relying on it. Nothing in this section limits mandatory consumer rights. 22. Liability Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. In particular, these Terms do not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or liability arising under mandatory consumer protection law. To the extent permitted by law, Humanity Badge is not responsible for: indirect or unforeseeable losses, decisions made solely on the basis of third-party or user-supplied content, conduct of other users outside our reasonable control, failure by a third-party organiser to provide a grant, job, course, event or opportunity, losses caused by a user failing to protect their account, external websites or services, events beyond our reasonable control. For users acting for business or professional purposes, our total liability arising from a paid service will not exceed the total amount paid by that user to Humanity Badge for the service giving rise to the claim during the 12 months preceding the event giving rise to liability, unless applicable law requires otherwise. This limitation does not apply to consumers where it would restrict mandatory statutory rights. 23. Closing your account You may stop using Humanity Badge and request closure of your account at any time by contacting: hello@humanitybadge.com Account closure may result in the removal or deactivation of your profile and User Content. Some information may be retained where necessary to: comply with legal obligations, process or document payments, prevent fraud or abuse, resolve disputes, establish, exercise or defend legal claims, maintain secure backup systems for a limited period. Closing an account does not automatically invalidate a legitimately issued micro-credential, although its public verification page may be affected depending on the credential’s settings and technical structure. 24. Suspension or termination by Humanity Badge We may suspend or terminate access where a user: materially or repeatedly violates these Terms, creates a serious risk to another user, uses the Platform unlawfully or fraudulently, threatens Platform security, fails to pay for a paid service, attempts to avoid an earlier suspension, provides false evidence in connection with a micro-credential. Where appropriate, we will give advance warning and an opportunity to correct the violation. Advance warning may not be provided where immediate action is necessary for safety, security, fraud prevention, legal compliance or protection of other users. 25. Changes to these Terms We may update these Terms to reflect: changes to the Platform, new legal requirements, security developments, changes to our services, improvements to the way the Platform operates. The current version will be published on humanitybadge.com. Where a change is significant, we will make reasonable efforts to notify registered users through the Platform, by email or through another appropriate method. Changes will apply from the effective date stated in the updated Terms. If you do not agree with an updated version, you may stop using the Platform and close your account. 26. Governing law and disputes These Terms are governed by Polish law. If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the law of the country in which you normally live. We encourage you to contact us first so that we can try to resolve any complaint: hello@humanitybadge.com A consumer may also use any consumer complaint, mediation or alternative dispute resolution procedure available under applicable law. Disputes involving consumers will be handled by the courts having jurisdiction under applicable consumer and procedural law. For disputes involving users acting exclusively for business or professional purposes, the courts competent for the registered office of Humanity Badge sp. z o.o. will have jurisdiction, unless mandatory law provides otherwise. 27. General provisions If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision immediately does not mean that we waive the right to enforce it later. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations in connection with a merger, restructuring, sale of the Platform or transfer of business, provided that this does not reduce mandatory user or consumer rights. These Terms, together with the Privacy Policy and any specific conditions displayed for a paid micro-credential, form the agreement between you and Humanity Badge concerning use of the Platform. 28. Dane profilowe zdjęcie profilowe, opis profilu, dane podane dobrowolnie przez użytkownika, informacje o aktywności w Portalu. 3.3. Dane związane z aktywnością społecznościową treści publikowane przez użytkownika (posty, komentarze, reakcje), wiadomości wysyłane w ramach Portalu, relacje z innymi użytkownikami. 3.4. Dane techniczne adres IP, dane urządzenia i przeglądarki, logi systemowe, dane zawarte w plikach cookies. 4. Widoczność danych w Portalu Użytkownik przyjmuje do wiadomości, że: dane profilowe oraz treści publikowane w Portalu mogą być widoczne dla innych użytkowników, zakres widoczności danych zależy od ustawień prywatności konta, Administrator nie ponosi odpowiedzialności za dalsze przetwarzanie danych przez innych użytkowników. 6. Odbiorcy danych Dane osobowe mogą być przekazywane: dostawcom hostingu i infrastruktury IT, dostawcom narzędzi analitycznych, podmiotom obsługującym systemy bezpieczeństwa, organom publicznym – na podstawie przepisów prawa. Dane nie są sprzedawane ani udostępniane w celach marketingowych bez zgody użytkownika. 7. Przekazywanie danych poza UE Jeżeli Administrator korzysta z narzędzi dostarczanych przez podmioty spoza UE (np. narzędzia analityczne), dane są przekazywane zgodnie z RODO, w szczególności na podstawie: standardowych klauzul umownych, decyzji stwierdzających odpowiedni stopień ochrony. 8. Okres przechowywania danych dane konta – przez czas posiadania aktywnego konta, dane po usunięciu konta – do 12 miesięcy (cele dowodowe), dane wymagane przepisami prawa – zgodnie z tymi przepisami. Po upływie tych okresów dane są usuwane lub anonimizowane. 9. Prawa użytkownika Użytkownik ma prawo do: dostępu do danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia danych, wniesienia sprzeciwu, cofnięcia zgody, wniesienia skargi do Prezesa UODO. 10. Pliki cookies Portal wykorzystuje pliki cookies w celu: zapewnienia prawidłowego działania, utrzymania sesji użytkownika, analiz statystycznych. Użytkownik może zarządzać cookies w ustawieniach przeglądarki. 11. Bezpieczeństwo danych Administrator stosuje środki techniczne i organizacyjne, w szczególności: szyfrowanie haseł, zabezpieczenia serwerów, kontrolę dostępu, procedury reagowania na incydenty. 12.
